NOTICE OF SALE
GEORGIA, WILCOX COUNTY.
By virtue of a power of sale contained in that certain Deed to Secure Debt from Kerney E Hair Jr to Colony Bank dated October 21, 2013, and recorded in Deed Book 299, Page 261, et seq., Wilcox County Deed Records having originally been given to secure that certain Promissory Note in the original principal amount of ONE HUNDRED FIFTY THOUSAND and 00/100 DOLLARS ($150,
000.00) of even date therewith, as well as all extensions, renewals and modifications thereof, together with any and all other indebtedness, of any type or description, then or thereafter owing by Kerney E Hair Jr to Colony Bank, there will be sold by the undersigned, at public outcry, to the highest bidder for cash, before the courthouse door at Abbeville, Wilcox County, Georgia, within the legal hours of sale on the first Tuesday in March, 2026, the following described property:
TRACT ONE: Twenty-five and three tenths (
25.3) acres, more or less, of land in the Southeast corner of Lot of Land 148 in the Fifth Land District of Wilcox County, Georgia, being in the form of a rectangle running East and West for one half the distance of the lot and North and South for one fourth of the distance of the lot.
TRACT TWO: All of the North Half of Lot of land Number One hundred Seventy-Three (173) in the Fifth (5th) Land District of Wilcox County, Georgia, containing 101 ¼ acres, more or less.
Said tracts being the same property described in a deed from Mrs. Viola B. Broadway to Johnnie W. hair and Vancine P. Hair dated January 4, 1963, recorded in Deed Book 70, page 450 and a deed from the Executors of the Vancine P. Hair Estate to Brenda H. Dennard for life with remainder interest to Susan Dennard, dated August 7, 2001, recorded in Deed Book 206, page 19, Wilcox County Records.
The indebtedness secured by the aforementioned Deed to Secure Debt has been and is hereby declared immediately due and payable in full because of the failure of Kerney E Hair Jr to maintain payments upon said indebtedness owing to the Colony Bank, in accordance with its terms. Said indebtedness remaining in default, this sale shall be made for the purpose of paying such indebtedness, as well as all expenses of this sale, including attorneys’ fees.
The above-described property will be sold as the property of Kerney E Hair Jr , and will be sold subject to the following items which may affect the title to said property: all zoning and subdivision ordinances and/or regulations; matters which would be disclosed by an accurate survey or an inspection of the property; all real property ad valorem taxes or assessments, which may constitute liens upon said property; all liens which, under applicable law, would take priority over the Deed to Secure Debt described above; and all easements, restrictions, rights-of-way, security deeds or other encumbrances of record which have priority over the referenced Deed to Secure Debt.
To the best of the knowledge and belief of the undersigned, the party presently in possession of said property is Kerney E Hair Jr, and/or a tenant or tenants.
Please be further advised that the entity which has full authority to negotiate, amend and modify all terms of the Note, Deed to Secure Debt, and related documents, is:
