Under and by virtue of the power of sale in a certain Deed to Secure Debt from BARBARA SERCER, Grantor, to WILCOX COUNTY STATE BANK, Grantee, dated the 15th day of April, 2015 and recorded in Deed Book 312, Page 419, Clerk’s Office, Wilcox County Superior Court, said Deed to Secure Debt having been given to secure a Note dated the 15th day of April, 2015 in the sum of $25,000.00
, there is due to be sold by the undersigned at public outcry, during the legal hours of sale before the Courthouse of Wilcox County, Georgia on the first Tuesday in May, 2021, to-wit: the 4th day of May, 2021 to the highest and best bidder for cash, the following described property:
One (1) acre of land in Lot of Land 141 in the Land District of Wilcox County, Georgia, being more particularly described as follows: Starting at a point which is the intersection of the center line County Road 68 and the center line of County Road 70 run South 01°06’30” East a distance of 962.01
feet to a point; thence run North 89°38’02” West a distance of 40 feet to a point on the West right of way of said County Road 68, the POINT OF BEGINNING: Thence from said point of Beginning run South 00°58’49” East along the West right of way of County Road 68 a distance of 137.49
feet to a point; thence run North 89°38’02” West a distance of 316.83
feet to a point; thence run North 00°58’49” West a distance of 137.53
feet to a point; thence run South 89°38’02” East a distance of 316.83
feet to the Point of Beginning. Said tract being more particularly described on a Plat of Survey prepared by Freddie J. Hattaway, Surveyor, dated 03/21/2015, recorded in Plat Book 7, Page 543, Slide A155, Wilcox County Records. Said tract being the same property described in a deed from James Harold Martin, Jr. to Barbara Sercer, dated 3/27/2015, recorded in Deed Book 312, Pages 201-202, Wilcox County Records. Said tract also being a portion of the property described in a deed from John E. McDonald to James H. Martin, Jr. dated 4/27/2006, recorded in Deed Book 244, Pages 353-354, Wilcox County Records. The property is located in Wilcox County at 2855 Briarwood Rd., Abbeville, Georgia 31001.
The debt secured by said Deed to Secure Debt and Note has been and is hereby declared due and payable in full because of default pursuant to the terms of said Deed to Secure Debt and note. Notice has been given to enforce provisions for collection of attorney’s fees and foreclosure in accordance with the legal requirements and the terms of the Deed to Secure Debt and Note. The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the Deed to Secure Debt, accrued interest and expenses of the sale and other sums secured by the Deed to Secure Debt, including the attorney’s fees and the remainder, after applying said proceeds to other indebtednesses owed by Grantors to Grantee, if any, shall be applied as provided by law.
To the best of the undersigned’s knowledge and belief, the property is in the possession of BARBARA SERCER and said property will be sold as the property of BARBARA SERCER. Said property will also be sold subject to all outstanding ad valorem taxes, street improvements, and easements or restrictions of record, if any, unpaid water or sewage bills that constitute a lien against the property whether due and payable or not yet due and payable and which may not be of record, the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, and any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the Deed to Secure Debt first set out above. The undersigned will execute a deed to the purchaser at said sale as provided in the Deed to Secure Debt. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt.
