NOTICE OF SALE
UNDER POWER CONTAINED
IN SECURITY DEED
STATE OF GEORGIA,
COUNTY OF Wilcox
Pursuant to a power of sale contained in a certain security deed executed by Toney Allegood, hereinafter referred to as Grantor, to Mortgage Electronic Registration Systems, Inc. as nominee for Ameris Bank recorded in Deed Book 321, beginning at page 153 and as modified at Deed Book 341, Page 370, of the deed records of the Clerk of the Superior Court of the aforesaid state and county, and by virtue of a default under the terms of said security deed, and the related note, the undersigned attorney-in-fact for the aforesaid Grantor (which attorney-in-fact is the present holder of said security deed and note secured thereby) will sell at the usual place of conducting Sheriff’s sales in said county within the legal hours of sale, for cash, to the highest bidder on the first Tuesday in February 2021, all property described in said security deed including but not limited to the following described property:
One (1) acre in Lot of Land 212 in the 8th Land District of Wilcox County, Georgia, being more particularly described as follows: Starting at a point which is the intersection of the West Land Lot Line of said Land Lot 212 and the South right of way of County Road 10 run South 04 degrees 00’ West a distance of 650 to a point; thence ran South 86 degrees East a distance of 30 feet to the Point of Beginning; thence from said Point of Beginning run South 86 degrees 00’ East a distance of 210 feet to a point; thence run South 04 degrees 00 West a distance of 210 feet to a point; thence run North 86 degrees 00’ West a distance of 210 feet to a point; thence run North 04 degrees 00’ East a distance of 210 feet to the Point of Beginning. Said tract being more particularly described on a Plat of Survey prepared by Earl D. Raines, Surveyor, dated 06/26/1980, a copy of which is attached as Exhibit “A” to Warranty Deed at Deed Book 265, page 33, and which is incorporated herein as part of this description.
Also, a 30 foot easement for access from the South right of way of County Road 10 to the Northwest comer of the above described tract and along the West land line of the said above described tract, and being more particularly described as follows: Beginning at a point which is the intersection of the West Land Lot Line of said Land Lot 212 and South right of way of County Road 10 run South 04 degrees 00’ West along the West Land Lot Line of said Land Lot 212 a distance of 860 feet to a point; thence run South 86 degrees 00’ East a distance of 30 feet to a point which is the Southwest comer of the above described tract; thence run North 04 degrees 00’ East along the West Land Line of said above described tract a distance of 210 feet to a point which is the Northwest comer of the said above described tract; thence run North 04 degrees 00’ East a distance of650 feet to a point on the South right of way of County Road 10; thence run in a Westerly direction along the South right of way of said County Road 10 a distance of 30 feet to the Point of Beginning.
Said above described tract and easement being the same property described in a deed from Joanne M. Stokesberry to Patrick Stokesberry and Kathy Stokesberry, dated 08/12/2005, recorded in Deed Book 238, page 270, Wilcox County Records.
Said legal description being controlling, however, the Property is more commonly known as: 122 Clover Lane, Abbeville, GA 31001
Said property will be sold on an “as-is” basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will be subject to the following items which may affect the title: any outstanding ad valorem taxes (including taxes which are a lien but not yet due and payable); any matters which might be disclosed by an accurate survey and inspection of the property; any assessments, liens, encumbrances, zoning ordinances, restrictions, and all other matters of record superior to the said Security Deed. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed. MidFirst Bank, through its division Midland Mortgage as loan servicer is the entity with full authority to negotiate, amend and modify the terms of the Note and Security Deed.
